By accessing and using Pebbly (the "Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Pebbly is a community platform for tracking painted rocks as they travel around the world. Users create painted rocks, attach QR codes or short codes, and track their journeys as others find and check them in at different locations.

When using Pebbly, you agree to:

• Provide accurate information when creating your account
• Maintain the security of your account credentials
• Use the Service in compliance with all applicable laws and regulations
• Respect other users and the community
• Only upload content (photos, descriptions) that you have the right to share
• Be truthful about check-in locations and rock findings

You may not:

• Upload inappropriate, offensive, or illegal content
• Harass, bully, or threaten other users
• Submit false or fraudulent check-ins to manipulate the system
• Attempt to hack, disrupt, or damage the Service
• Use automated tools (bots) to create fake accounts or check-ins
• Spam other users or the platform
• Violate any third-party intellectual property rights
• Use the Service for commercial purposes without our permission

Your Content

You retain all ownership rights to the photos, descriptions, and other content you upload ("Your Content"). By uploading Your Content to Pebbly, you grant us a worldwide, non-exclusive, royalty-free license to:

• Display, store, and distribute Your Content as part of the Service
• Show Your Content to other users of the platform
• Use Your Content for promotional purposes (with attribution)

You can delete Your Content at any time through your account settings. Upon deletion, we will remove Your Content from public view, though backup copies may remain in our systems.

QR Codes and Tracking Tags

QR codes and short codes generated by Pebbly remain property of the Service. These codes are provided for your use in tracking your painted rocks and may not be used for other commercial purposes.

Platform Content

All other content, design, logos, and functionality of Pebbly are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in:

• Fraudulent activity (fake check-ins, location spoofing)
• Harassment or abusive behavior toward other users
• Uploading inappropriate or illegal content
• Attempting to compromise the security or integrity of the Service

You may delete your account at any time through your account settings. Upon account deletion, your personal data will be removed according to our Privacy Policy.

Pebbly is provided "as is" without warranties of any kind, either express or implied. We do not guarantee:

• That the Service will be uninterrupted or error-free
• That GPS locations will always be accurate
• That rocks will be found or check-ins will be legitimate
• That user-uploaded content is accurate or appropriate

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Pebbly is a virtual tracking platform. We are not responsible for physical rocks, their condition, or any issues arising from placing or finding rocks in real-world locations.

Your use of Pebbly is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy to understand our data practices.

By using the Service, you consent to our collection and use of:

• Email address (for account management)
• GPS location data (for check-ins and origin tracking)
• Photos (for rock and check-in displays)
• Device information (for anti-fraud purposes)

If you have a dispute with another user, we encourage you to resolve it directly. If you have a dispute with Pebbly, please contact us first at support@pebbly.art to attempt an informal resolution.

These Terms are governed by Polish law, and disputes are resolved by the competent common courts in Poland. If you are a consumer, this does not take away the protection given to you by the mandatory laws of your country of residence, and you may also bring a claim before the courts of your place of residence.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or through a notice on the Service. Your continued use of Pebbly after changes are posted constitutes your acceptance of the updated terms.
